18. What Would the Air Permit Allow?

Site Layer 1 proposes a power plant alongside a data center. This is different from a facility with emergency generators that run only for outages and tests. Its published notice contemplates 32 natural-gas engines and potential operation throughout the year. Residents need to understand the actual operating limits a permit would authorize.

The notice gives preliminary emissions estimates. It is not a final permit, a measurement of future emissions, or a complete exposure assessment. The application should show expected and permitted maximum operating hours, fuel use, pollutant rates, stack characteristics, control equipment, and modeled concentrations at nearby homes and other sensitive places. It should account for startup, shutdown, maintenance, and cumulative sources where required.

The US Environmental Protection Agency identifies air permitting and standards relevant to stationary engines and turbines used by data centers. New Mexico’s Environment Department must review the application under applicable rules. Residents should look for enforceable limits and how the operator will demonstrate compliance, not just a statement that the equipment is modern.

There is a local procedural update. In a September 18, 2026 letter, NMED said it would not advance a Site Layer 1 air application until the applicant supplied a qualified public contact and records of stakeholder engagement. That was an application-completeness finding about participation, not a technical decision that the proposed emissions are acceptable or unacceptable. Later filings need to be checked separately.

Air quality and climate questions deserve distinct treatment. A facility can meet local ambient-pollutant limits while still emitting substantial greenhouse gases from continuous fuel combustion. The community should ask for both sets of figures and for the assumptions behind them. A promise to buy renewable electricity elsewhere would not erase local engine exhaust if those engines operate here.

What a useful answer would include

The complete application and modeling, an understandable summary of permit limits, a map of modeled receptors, monitoring and reporting requirements, and a clear process for complaints and enforcement.
